RESUMEN: En la generalidad de los escenarios, el paciente manifiesta el consentimiento informado en el momento inmediatamente anterior a la realización de la intervención sanitaria de que se trate. Sin embargo, es posible acudir a las instrucciones previas o voluntades anticipadas como un medio para dejar constancia de la voluntad del usuario y que la misma se aplique con posterioridad. No obstante, la parquedad de la Ley 41/2002, de 14 de noviembre, presenta importantes dudas interpretativas. En este sentido, en el presente estudio abordaremos tres problemáticas vinculadas a estos documentos: los sujetos legitimados; las formalidades requeridas y, en todo caso, las que debieran incluirse; y el efecto del paso del tiempo y su necesaria actualización y revisión.

ABSTRACT: In most scenarios, the patient expresses informed consent immediately before performing the health intervention in question. However, it is possible to use advance directives to record and apply the user’s will later. However, the sparsity of Law 41/2002, of 14 November, presents important interpretative doubts. In this sense, this study will address three problems linked to these documents: the legitimated subjects, the formalities required and, in any case, those that should be included, and the effect of the passage of time and its necessary updating and revision.
