Resumen: Il contributo affronta la quaestio iuris della responsabilità civile dei veicoli a guida autonoma nel contesto normativo italo-europeo. L’autrice dopo aver ricostruito il quadro normativo attuale, prospetta le diverse ipotesi che si possono presentare in caso di incidente causato da un veicolo a guida autonoma e fornisce le soluzioni corrispondenti, le quali però non rispondono all’esigenza di una tutela piena del soggetto danneggiato, per cui propone una diversa interpretazione del fenomeno attraverso il metodo dell’analogia iuris, grazie al quale sarà possibile il riconoscimento di una personalità giuridica in capo ai veicoli a guida autonoma, non come surrogato della persona fisica, ma seguendo gli stessi principi che hanno portato a tale risultato per gli enti privati.

Abstract: The essay addresses the quaestio iuris of the civil liability of self-driving vehicles in the Italian-European regulatory context. After reconstructing the current regulatory framework, the author outlines the various hypotheses that may arise in the event of an accident caused by an autonomous driving vehicle and provides the corresponding solutions, which, however, do not meet the need for full protection of the injured party, for which she proposes a different interpretation of the phenomenon through the method of analogia iuris, thanks to which it will be possible to recognise a legal personality for autonomous driving vehicles, not as a surrogate for the natural person, but following the same principles that have led to this result for private entities.
