Resumen: En este artículo se relata la evolución normativa que ha tenido la figura del agente encubierto en el ordenamiento jurídico italiano. Posteriormente, analizo su vertiente como diligencia de investigación en la instrucción del proceso penal y para ello especifico las personas que pueden protagonizar las actividades encubiertas, describo la autorización que deben obtener, la información que deben aportar al proceso así como la duración que pueden tener sus operaciones. Delimito su ámbito de actuación, expongo los delitos que pueden investigar, las actividades que pueden realizar y explico su posible exención de responsabilidad criminal. Una vez analizada la primera de sus vertientes o roles en el proceso penal, expongo la segunda, que es constituir un medio probatorio y una fuente de pruebas en el juicio oral, analizando para ello la testifical del encubierto y el resto de medios probatorios que aporta el agente encubierto al proceso. Por último, me centro en el agente encubierto virtual en Italia relatando sus principales características y funciones.

Abstract: This article describes the regulatory evolution of undercover agents in the Italian legal system. Later, I analyse its role as an investigative measure in criminal proceedings, specifying the persons who may be involved in undercover activities, describing the authorisation they must obtain, the information they must provide to the prosecution and the duration of their operations. I delimit their scope of action, outline the crimes they can investigate, the activities they can carry out and explain their possible exemption from criminal liability. Once the first of its aspects or roles in the criminal process has been analysed, I will explain the second, which is to constitute a means of proof and a source of evidence in the oral trial, analysing the testimony of the undercover agent and the rest of the means of proof that the undercover agent brings to the process. Finally, I focus on the virtual undercover agent in Italy by outlining his main characteristics and functions.
