RESUMEN: L’articolo indaga il ruolo della buona fede contrattuale all’interno dei diversi modelli giuseconomici. Da una originaria esclusione, dovuta sia agli strumenti tipici dell’analisi economica sia alla mentalità intrinseca del common lawyer, si assiste ad una sua “rivalutazione” non solo grazie alla sua associazione con la reasonableness, ma anche in virtù delle nuove scoperte nel campo delle neuroscienze e dell’economia comportamentale.

ABSTRACT: The article investigates the role of contractual good faith within the different Law & Economics models. From an original exclusion, due to both the typical tools of economic analysis and the inherent mentality of the common lawyer, there is a “reassessment” of it not only due to its association with reasonableness, but also by virtue of new discoveries in the field of neuroscience and behavioural economics.
