Resumen: La carencia de vivienda digna y la búsqueda de fórmulas adecuadas para posibilitar un envejecimiento activo de la población constituye una preocupación social con importantes repercusiones jurídico-civiles, pero poco estudiada. Una de las opciones de mayor fomento, a instancias públicas, es el modelo de vivienda colaborativa, también conocido como “cohousing”, aunque no siempre identificada con los mismos términos equivalentes. En la Comunidad Valenciana se ha aprobado la Ley 3/2023, de 13 de abril, de viviendas colaborativas, que constituye un referente en el tratamiento jurídico de esta materia. En este trabajo se contextualiza dicha Ley dentro de las políticas públicas en torno al derecho de acceso a la vivienda digna. Además, se realiza un análisis reflexivo del régimen jurídico de la vivienda colaborativa en esta Ley autonómica, así como de la naturaleza societaria de la cesión del derecho de uso a favor de los usuarios de esta tipología habitacional.

Abstract: The lack of dignified housing and the search for suitable formulas to enable active population ageing constitute a social concern with significant legal-civil repercussions. Still, it is a topic that has yet to be fully studied. One of the most promoted options by public authorities is the collaborative housing model, also known as “cohousing,” although these terms are not always equivalent. In the Valencian Community, Law 3/2023 of April 13, on collaborative housing, has been approved, serving as a reference in the legal treatment of this matter. The present work contextualises this Law within public policies concerning the right to dignified housing. Additionally, it provides a reflective analysis of the legal regime of collaborative housing in this regional Law and the corporate nature of the transfer of the right of use in favour of the users of this housing typology.
