Resumen: El presente comentario tiene por objeto analizar la sentencia de la Corte Suprema de Chile del año 2020 que, amparándose en una interpretación literal del art. 1 del Acta 103-2018, rechaza la idea de que la conducta del denunciado sea constitutiva de acoso sexual. Lo anterior, permitirá defender la predominancia de la interpretación sistemática de la norma en conjunto con la aplicación conceptual de organismos internacionales, la doctrina y las normas de otros ordenamientos jurídicos, a efectos de obtener un razonamiento acorde al uso y comprensión habitual que se tiene del término.

Abstract: The purpose of this commentary is to analyze the sentence of the Supreme Court of Chile of the year 2020 which, based on a literal interpretation of art. 1 of Act 103-2018, rejects the idea that the conduct of the accused constitutes sexual harassment. This will make it possible to defend the predominance of the systematic interpretation of the norm in conjunction with the conceptual application of international organizations, the doctrine and the norms of other legal systems, in order to obtain a reasoning according to the usual use and understanding of sexual harassment.
