Resumen: El estudio tiene como propósito aportar en la discusión epistemológica y práctica sobre la justicia con enfoque intercultural, para ello se plantea un análisis desde la experiencia del derecho comparado y se evalúa los avances y retos tanto de la Comisión de Justicia Intercultural del Poder Judicial como de la Oficina de Coordinación y Asistencia en Justicia Intercultural del Ministerio Público; finalmente, se describe la puesta en práctica de la justicia intercultural a partir del caso de la provincia de Bagua, región Amazonas. A partir de todo ello, se advierte que los operadores del derecho tienen el enorme reto de acceder el derecho a la justicia a los pueblos indígenas históricamente excluidos e invisibilizados y que hoy reclaman un protagonismo político, social y jurídico.

Abstract: The purpose of the study is to contribute to the epistemological and practical discussion on justice with an intercultural approach. To this end, an analysis is made from the experience of comparative law and the progress and challenges of both the Intercultural Justice Commission of the Judiciary and the Office of Coordination and Assistance in Intercultural Justice of the Public Prosecutor’s Office are evaluated; finally, the implementation of intercultural justice is described based on the case of the province of Bagua, Amazonas region. From all this, it is noted that the operators of the law have the enormous challenge of accessing the right to justice to indigenous peoples historically excluded and invisibilized and that today they demand a political, social and legal protagonism.
