Resumen: il tema sottoposto a disamina nel presente saggio si inserisce nel solco della riforma della filiazione di cui il Prof. Cesare Massimo Bianca è stato fervido ed appassionato promotore. Sebbene il decreto attuativo della riforma con cui il legislatore italiano ha riconosciuto l’unicità dello status di figlio non abbia scalfito la norma implicita desumibile dal sistema in base alla quale al figlio (nato nel matrimonio) è attribuito il cognome del padre, non può negarsi come esso abbia in qualche modo inciso anche sulla disciplina del cognome, orientando in particolare le successive pronunce della giurisprudenza, non solo nazionale ma europea. Dopo aver brevemente ripercorso l’iter giurisprudenziale fino ad oggi delineatosi in materia di attribuzione del cognome al figlio, analizzando da ultimo la recente ordinanza della Corte costituzionale n. 18/2021, nonché l’ultimo disegno di legge presentato nel corso dell’attuale legislatura, si ritiene – alla luce delle riflessioni svolte – che i tempi siano ormai maturi per l’approvazione in Italia di una legge che si adegui alle normative vigenti in altri paesi europei ove, sia pure con soluzioni diverse, si è approdati ad un regime meno discriminatorio nei confronti della donna e più coerente con l’esigenza di garantire l’effettiva parità dei genitori e tutelare il diritto all’identità personale del minore ad essere identificato sin dalla nascita anche con il cognome della madre.

Abstract: The topic examined in this essay is in line with the reform on filiation of which Prof. Cesare Massimo Bianca has been a fervent and passionate promoter. Although the decree implementing the reform, by which the Italian legislator recognized the uniqueness of the status of the child, has not undermined the implicit rule inferable from the practice according to which a child (born in wedlock) is attributed the father’s surname, it cannot be denied that it has in some way also affected the regulation of the surname, in particular leading the subsequent rulings of case law, not only regarding national case law, but also the European one. After briefly reviewing the jurisprudential process up to now on the attribution of the surname to the child, by analysing the recent order of the Constitutional Court no. 18/2021, as well as the latest bill presented during the current legislature, it is deemed – in the light of the considerations carried out – that the time is now right for the approval of a law in Italy which complies with the regulations in force in other European countries where, albeit with different solutions, a less discriminatory regime towards women has been adopted, which is more consistent with the need to ensure the effective equality of parents and to protect the right to the personal identity of the minor to be identified also with the mother’s surname from birth on.
