Resumen: En este trabajo se analiza críticamente la doctrina jurisprudencial contenida en las SSTS 531/2018, de 26 de septiembre, y 539/2018, de 28 de septiembre, por la que se considera que devienen automáticamente ineficaces las instituciones hereditarias y los legados dispuestos en favor del cónyuge o pareja de hecho cuando el beneficiario deje de serlo ulteriormente y aunque el testador no haya supeditado de manera expresa la eficacia de la disposición mortis causa a la subsistencia, al instante de la apertura de la sucesión, del vínculo en cuestión.

Abstract: This paper seeks to provide a critical analysis of the case-law established by the Spanish Supreme Court judgments 531/2018, of September 26, and 539/2018, of September 28. Both of them consider that the institution of heirs and legacies in favour of the spouse or unmarried partner become automatically ineffective when the beneficiary ceases to be that, even if the testator has not expressly subordinated the effectiveness of the disposition mortis causa to the subsistence of the marriage or relationship at the time of the opening of the succession.
