Resumen: El debate entorno al ius delationis siempre ha estado presente en la doctrina española, encontrando dos teorías al respecto. La teoría clásica defendida por LACRUZ y la teoría moderna sostenida por ALBALADEJO y VALLET. Optar por una otra trasciende del mero debate académico, dando lugar a importantes consecuencias en el plano civil y fiscal.

Sin embargo, en la última década el debate se ha visto acrecentado por el continuo cambio de criterio jurisprudencial en el Tribunal Supremo y Dirección General de la Seguridad Jurídica y Fe Pública, pudiendo así afectar al principio de seguridad jurídica y otros que inspiran nuestro ordenamiento jurídico.

Abstract: The debate around ius delationis has always been present in Spanish doctrine, finding two theories in that regard. The traditional theory defended by LACRUZ and the modern theory supported by ALBALADEJO and VALLET. Choosing one or another transcends from the academic discussion, leading to important consequences at the civil and tax areas. However, in the last decade the debate has been increased by the continuous change of jurisprudential criteria by the Supreme Court and “Dirección General de la Seguridad Jurídica y Fe Pública”, thus being able to affect the principle of legal certainty and others that inspire our legal system.
