Resumen: Il presente contributo intende delineare l’evoluzione del diritto del minore a crescere nell’ambito della sua famiglia. Si prendono le mosse dall’analisi dell’attuale rapporto tra la persona e la famiglia, per giungere a esaminare la peculiare relazione tra il minore e il contesto affettivo d’origine, e la normativa di riferimento. Al riguardo, viene evidenziato il fondamentale apporto che è stato fornito dalla Riforma della filiazione ideata dal Prof. Cesare Massimo Bianca. La Riforma, in particolare, ha dato effettività agli interventi di sostegno che impediscono che le eventuali difficoltà materiali della famiglia possano comportare l’adottabilità del figlio minore.

Abstract: This essay intends to describe the evolution of the child’s right to live within his family. It starts from the analysis of the current relationship between the person and the family, to arrive at examining the particular relationship between the child and the emotional context of his family, and the relevant legislation. In this regard, the fundamental contribution that was provided by the Reform of the filiation conceived by Prof. Cesare Massimo Bianca must be highlighted. The Reform, in particular, has given effect to the support interventions that prevent any material difficulties of the family that can cause the adoptability of the minor child
