Resumen: El presente trabajo tiene por objetivo analizar el beneficio de naturaleza afectiva que se deriva de las salidas de niños, niñas y adolescentes al extranjero acompañados de sus madres custodias. Para tal efecto, se analiza el aspecto afectivo como parte integrante del principio del interés superior y el reconocimiento de lo anterior tanto en los textos internacionales relativos a la defensa de la infancia y adolescencia como en el Derecho de familia chileno. Realizado lo recientemente indicado, basándonos en la jurisprudencia chilena, se estudia a los progenitores como figuras de apego y la relevancia de la familia extensa.

Abstract: The purpose of this paper is to analyze the affective benefit derived from the departure of children and adolescents abroad accompanied by their custodial mothers. For this purpose, the affective aspect is analyzed as an integral part of the best interest principle and the recognition of the above both in international texts related to the defense of children and adolescents and in Chilean family law. Based on Chilean jurisprudence, we study parents as attachment figures and the relevance of the extended family.
