Resumen: Rievocato lo statuto normativo, di conio romano, dell’azione redibitoria, nel saggio si dà conto dell’attuale regime giuridico italiano del mezzo, i cui caposaldi sono fissati nel codice civile del 1942. Rispetto a un punto del medesimo, viene valorizzato un insegnamento di Cesare Massimo Bianca, meritevole di essere seguito anche nei contenziosi in cui il compratore agisce fruttuosamente contro il venditore con l’azione quasi redibitoria che gli concede il codice del consumo del 2005, per questa parte in attesa della riforma imposta dalla direttiva 2019/771/UE.

Abstract: After recalling the fundamental principles of the redhibitory action, which were laid down by the Romans, the essay addresses the current Italian legal regulation of this remedy, whose cornerstones are enshrined in the Civil Code of 1942. With reference to a specific issue, the essay enhances a solution by Cesare Massimo Bianca, which deserves to be followed even in disputes in which the buyer brings against the seller the quasi-redhibitory action that is granted to him by the Consumer Code of 2005 (in this respect awaiting the reform required by Directive 2019/771/EU).
