Resumen: El derecho fundamental a la libertad de expresión aparece proclamado en el artículo 20 de la vigente Constitución española de 1978. El presente trabajo tiene como objeto analizar cuál ha sido el reconocimiento y las garantías que dicho derecho ha recibido en el sistema constitucional histórico español para comprender la protección que en la actualidad le otorga nuestro Poder Constituyente y el reflejo que la misma tiene en nuestra legislación y jurisprudencia.

Abstract: The fundamental right to freedom of expression is proclaimed in article 20 of the current Spanish Constitution of 1978. The purpose of this paper is to analyze what has been the recognition and guarantees that said right has received in the Spanish historical constitutional system in order to understand the protection currently granted by our Constituent Power and the reflection that it has in our legislation and jurisprudence.
