Resumen: Il saggio, muovendo dall’analisi degli interessi sottesi alla disciplina della c.d. pubblicità sanante, ne indaga i profili applicativi, sia in relazione al diverso atteggiarsi delle patologie negoziali dalle quali il negozio nullo può essere affetto, solo in alcuni casi rilevabili dall’ispezione del titolo, sia in ordine ai limiti operativi derivanti dall’assunzione del requisito soggettivo della buona fede nell’accezione di mera ignoranza del vizio di nullità. In chiusura si prospetta, nell’ottica di privilegiare l’esigenza di speditezza nella circolazione giuridica rispetto alla tutela dell’alienante che sia rimasto inerte per un certo periodo di tempo senza far valere le proprie ragioni, una riformulazione dell’art. 2652 n.6 c.c.

Abstract: The essay, starting from the interests analysis underlying the discipline of s.c. regularizing publicity, investigates the application profiles, both in relation to the different attitude of the negotiation pathologies from which the null legal transaction can be affected, only in some cases detectable by the inspection of the deed, and in relation to the operational limits derived from the operating assumption of the subjective requirement of good faith in the sense of mere ignorance of the flawnullity. In closing it suggests, with a view favoring the need for speed in legal circulation over the protection of the transferor who has remained inactive for a certain period of time without asserting his reasons, a reformulation of Article 2652 no. 6 c.c.
