Resumen: Se analiza si realmente la Administración responde cuando se ocasiona un daño por el funcionamiento normal del servicio público sanitario o, por el contrario, la regla es la inversa, sólo habrá responsabilidad cuando el funcionamiento del servicio ha sido anormal. A pesar de lo que afirma la norma, tanto de la doctrina como de la jurisprudencia resulta que no se da efectividad al carácter objetivo de la responsabilidad de la Administración en el ámbito sanitario.

Abstract: It’s analyzed whether the Administration really responds when damage is caused by the normal operation of the public sanitary service or, on the contrary, the rule is the inverse, there will only be responsibility when the operation of the service has been abnormal. Despite what the law affirms, both from doctrine and case law it turns out that the objective nature of the responsibility of the Administration in the health field is not given effect.
