RIASSUNTO: Il saggio, partendo dall’inquadramento del concetto di cybersicurezza, esplora la crescente necessità di riconoscervi o meno, nell’ambito del sistema dei diritti, la qualifica di diritto fondamentale, in risposta alle minacce digitali. Attraverso l’analisi del quadro giuridico di riferimento, nazionale e sovranazionale e sulla base del crescente bisogno di cybersicurezza – in quanto essenziale non solo a proteggere le infrastrutture informatiche ma anche alla salvaguardia della dignità umana e delle libertà della persona nell’era digitale – il presente lavoro invita ad adottare un approccio alla regolazione digitale incentrato sulla persona, proponendo il riconoscimento della cybersicurezza come autonomo diritto attraverso una fonte di livello sovranazionale.

ABSTRACT: Starting from an overview of the concept of cybersecurity, this essay explores the growing need to recognize it as a fundamental right within the system of rights, in response to digital threats. Through an analysis of the national and supranational legal framework of reference, and based on the growing need for cybersecurity – as essential not only to protect critical infrastructure but also to safeguard the integrity of the democratic system – the essay examines the legal and ethical implications of cybersecurity. Through an analysis of the national and supranational legal framework and based on the growing need for cybersecurity – as it is essential not only to protect IT infrastructure but also to safeguard human dignity and individual freedoms in the digital age – this work calls for the adoption of a human-centered approach to digital regulation on the human being, proposing the recognition of cybersecurity as an autonomous right through a supranational source.
