Resumen: Nell’ambito delle vicende del soggetto, profilo particolare del quale gli ordinamenti tutti si sono, in un modo o nell’altro, occupati, riguarda la incertezza circa le sorti del medesimo. Il legislatore del 1942, discostandosi in parte dalla tradizione precedente, ha deciso di superare la situazione di incertezza creata dalla scomparsa di un soggetto accompagnata dal perdurare della carenza di notizie, attraverso la dichiarazione di morte presunta del soggetto, con cui si pone fine alla persona della quale, per un lasso di tempo dato, si ignora l’esistenza. Obiettivo dell’indagine è verificare la incidenza della dichiarazione di morte presunta, e dell’eventuale ritorno del soggetto di cui fu dichiarata la morte presunta, sulla circolazione dei beni ed il relativo sistema di pubblicità.

Abstract: In the context of a person’s events, a particular aspect that all legal systems have dealt with in one way or another concerns uncertainty on the person’s fate. In 1942 Italy’s legislator, partly departing from the previous tradition, decided to overcome the situation of uncertainty created by the disappearance of a person accompanied by a continuous lack of information, by declaring the person’s presumed death. The declaration puts an end to a person whose existence has been unknown for a given period of time. The aim of this work is to verify the effect of the declaration of presumed death. It further examines the implications of an eventual reappearance of the person whose death was declared, of the circulation of assets and of the related system of publicity.
