RESUMEN: Es frecuente asimilar edad avanzada con falta de aptitud y vulnerabilidad, y más intensamente cuando se trata de personas internadas en centros socio sanitarios o geriátricos. Limitando la libertad del testador que se halla internado, se han introducido normas destinadas a impedir que instituciones de asistencia o personas vinculadas a ellas puedan ser favorecidas, pero sin diferenciar entre internamiento voluntario e involuntario y, por ello, sin tener en cuenta la presunción de capacidad para otorgar testamento, como tampoco el empleo cada vez más extendido de las disposiciones testamentarias de cuidado.

ABSTRACT: It is common to associate old age with a lack of competence and vulnerability, and even more so when it comes to people in social care or geriatric centers. Limiting the freedom of testators who are institutionalised, rules have been introduced to prevent care institutions or persons associated with them from being favoured, but without distinguishing between voluntary and involuntary institutionalisation and, therefore, without considering the presumption of capacity to make a will, nor the increasingly widespread use of testamentary care provisions.
