Resumen: La Convención sobre los Derechos de las personas con Discapacidad supuso un cambio de paradigma en el tratamiento jurídico de la discapacidad. El Estado español se adapta a esta normativa mediante Ley 8/2021, por la que se reforma la legislación civil y procesal para el apoyo de las personas con discapacidad en el ejercicio de la capacidad jurídica. Esta Ley introduce numerosos cambios en materia de capacidad para otorgar testamento y de medidas de apoyo a la discapacidad en esta materia. En el presente trabajo se profundizará, desde el prisma de los principios que inspiran esta Ley, en la función de las medidas de apoyo en el momento de otorgar testamento y de conformar la voluntad testamentaria y en las salvaguardas y medidas para evitar la captación de la voluntad del testador.

Abstract: The Convention on the Rights of Persons with Disabilities represented a paradigm shift in the legal treatment of disability, the Spanish State adapts to this regulation through Law 8/2021, which reforms civil and procedural legislation for support of people with disabilities in the exercise of legal capacity, this Law introduces numerous changes in terms of capacity to make a will and measures to support disability in this area; In particular, we will deepen, from the prism of the principles that inspire this Law, in the function of the support measures at the moment of granting a will and of conforming the testamentary will and in the safeguards and measures to avoid the capture of the will of the testator.
